In most jurisdictions around the world people do not have a right to consume recreational drugs, experimental medications or purchase many drugs without a prescription. In order to make the way we regulate drugs consistent with the doctrine of informed consent, we need to overhaul current drug regulations to make them more permissive. Prescriptions for most controlled drugs, such as morphine, are valid for 28 days.
Such a consideration is a factor against prosecuting unless the offence is serious or there is the possibility that it may be repeated. Relevant factors would include the quantity and the location of the prepared product, along with the steps that had been taken to make it ready for onward supply. In cases where the accused was plainly concerned in the supply of controlled drugs, but a trial issue may be their knowledge of/involvement in importation, further or alternative MDA charges should be considered. In addition to the supply of a controlled drug, section 4(3)(a)-(c) of the Act creates offences of offering to supply, being concerned in the supply and being concerned in the making of an offer to supply.
Families with substance misuse problems may also be experiencing domestic violence, unemployment, poverty or housing instability. A number of schemes have been established to provide counselling and exchange facilities where sterile equipment can be obtained. In the case of specified health care professionals, this includes needles and in the case of drug treatment providers, this includes aluminium foil. Articles or substances that may be caught by the offence include new psychoactive substances not already controlled under the Misuse of Drugs Act 1971 and other non-controlled drugs frequently abused drugs by prisoners. Fentanyl is approximately 50 times more potent than heroin and 100 times more potent than morphine.
It is important that courts adhere to the statutory requirement and do not too readily accept that the circumstances are exceptional. A factor is unlikely to be regarded as exceptional if it would apply to a significant number of cases. Any requirement(s) imposed for the purpose of rehabilitation should be determined by, and align with, the offender’s needs.

When considering a community or custodial sentence, the court must request and consider a pre-sentence report (PSR) before forming an opinion of the sentence, unless it considers that it is unnecessary (section 30 of the Sentencing Code).
